Subscription Landscaping & Tree Care Service Agreement

This Subscription Service Agreement (“Agreement”) is entered into between Branching Out Tree & Yard Care, operating in Boundary Creek, New Brunswick (“Contractor”), and the customer purchasing services (“Client”).

By booking, subscribing to, or receiving services under any subscription level, the Client agrees to the terms outlined below.

1. Subscription Levels & Scope of Services

Contractor offers three subscription service levels: Minimum, Standard, and Premium. Each level includes specific services as described on the Contractor’s website at the time of booking.

Services may include, but are not limited to:

  • Lawn mowing and edging during the growing season

    • Lawn mowing does not include bagging and disposal. Additional fees will be added if home owner requires this service.

  • Garden bed maintenance (weeding and light pruning)

  • Seasonal clean-ups

  • Tree care services (where applicable)

  • Dog waste removal (if purchased) includes the routine collection of dog feces from designated areas of the property during scheduled service visits. All collected dog waste will be securely bagged and disposed of in the homeowner’s on-site trash bin, unless otherwise agreed to in writing.

The exact services included depend on the subscription level selected by the Client.

2. Service Frequency & Billing

Clients may select weekly or bi-weekly service options.
All subscription services are billed on a bi-weekly billing cycle, regardless of service frequency.

Billing is automatic every two weeks and continues until the subscription is cancelled in accordance with this Agreement.

3. Tree Care & Arborist Oversight

All tree-related services are overseen by an ISA Certified Arborist.

Subscription services may include minor pruning or trimming performed from the ground only. Subscription services do not include:

  • Tree climbing

  • Aerial lifts

  • Large limb removal

  • Full tree removals

Any tree work beyond minor pruning requires a separate assessment, quote, and written approval.

4. Pricing Assumptions & Additional Charges

Quoted prices assume:

  • Clear, unobstructed access to service areas

  • Standard terrain and site conditions

  • No undisclosed hazards or utilities

Additional charges may apply if site conditions are not straightforward, including but not limited to:

  • Restricted access or steep slopes

  • Excess debris or obstacles

  • Underground or overhead utilities

  • Additional time or specialized equipment

5. Client Responsibilities

Client agrees to:

  • Provide safe and reasonable access to the property

  • Clearly mark or disclose underground utilities, septic systems, irrigation lines, and private wiring

  • Remove pet waste (if not paying for the service), toys, lawn furniture, vehicles, and personal items from service areas

Contractor is not responsible for damage caused by undisclosed or unmarked features.

7. Weather, Scheduling & Service Adjustments

Services are weather-dependent. Contractor reserves the right to delay or reschedule services due to:

  • Unsafe weather conditions

  • Equipment failure

  • Emergency or operational constraints

Lawn mowing and gardening services will continue during light or minor rain. In the case of heavy rain, thunderstorms, or unsafe conditions, we may need to reschedule your service. Clients will be notified promptly if any changes are required.”Missed services due to weather or safety concerns may be rescheduled when feasible but are not guaranteed to occur within the same service cycle.

8. Damage & Liability

Contractor will take reasonable care while performing services. Liability is limited to direct damage caused by Contractor negligence.

Contractor is not liable for:

  • Normal wear and tear

  • Damage caused by pre-existing conditions

  • Tree or limb failure outside the immediate scope of work

  • Indirect or consequential damages

9. Discounts & Additional Services

Any discounts included with a subscription level apply only while the subscription remains active and cannot be combined or applied retroactively unless stated otherwise.

10. Payment & Non-Payment

Failure to process payment may result in:

  • Suspension of services

  • Loss of priority scheduling

  • Cancellation of the subscription

Outstanding balances may be subject to collection.

11. Cancellation & Termination

Client may cancel a subscription with written notice prior to the next billing cycle.

No refunds will be issued for:

  • Services already rendered

  • Billing periods already processed

Contractor reserves the right to terminate service for non-payment, unsafe conditions, or repeated access issues.

12. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of New Brunswick, Canada.

13. Acceptance

By booking services, completing checkout, or allowing work to proceed, the Client acknowledges that they have read, understood, and agreed to this Agreement.
